INTERPRETATION OF A WILL

An action involving the interpretation of the will of the late 'William Ferguson, farmer, of Waikumete, Auckland, was heard at the Supreme Court to-day in Chambers, before his Hohour the Chief Justice (Sir Robert Stout). For the Public Trustee (the plaintiff) Mr. F. S. Kelly appeared, and Mr. P. Levi for Young Bros., the executors of the estateThe testator in his will bequeathed a quarter of his money ahd property (approximating in all £125) to his sister Janet Ferguson (later Mrs. Young), and "to' her heirs and assigns." She predeceased the testator, and the point to be determined was whether her children were entitled to succeed to her interest in the bequest, or whether her share lapsed with her death. After hearing short legal argument and the citation of authorities his Honour reserved his decision.
