Mr. Justice Sargent held that the case was covered by the clause suspending the contract during the continuance of events beyond the control of the vendors or buyers, and which prevented or delayed the carrying out of the agreement. He granted an injunction restraining the directors from aciin'g on the assumption that the contract had terminated, and added that it was undoubtedly a. case that should go to the highest tribunal.)
