RAILWAYMEN AND THE MINISTER. CASE FOR SUPREME COURT TO DECIDE. Questions involving matters of considerable interest to railwaymen are contained in an originating summons mentioned in Cbamburs before Mr. Justice Hosking to-day and set down for hearing for next Friday. The following are the questions at issue which the Judge will be asked to decide: — 1. On an appeal by a member of the Government Railways Department against the decision of the permanent head of that Department upon a question what are the rights of the appellant and upon what principles is he entitled to have his apf>eai decided? 2. On such an appeal is the Appeal Board justified in dismissing the appeal upon the ground that the General Manager of the Government Railways Department, as the permanent head of tho Department and the officers on whose opinion he relied, acted conscientiously and to the best of their information and belief? 3. On such an appeal is the Appeal Board justified in dismissing the appeal as mentioned in the last preceding question except after considering and weighing the evidence adduced on the hearing of the appeal? 4. On such an appeal is the appellant not entitled to have his case decided on the merits and according to the weight of evidence, or is it necessary for an appellant, in order to enable him to succeed, to show a want of good faith on the part of the general manager or the officers advising the general manager.
