UNIQUE POSITION
A unique position was revealed in the Magistrate's Court this afternoon. A young man named John Barnes, 22 years of agR. was found guilty ih the Supreme Court a little time back of the theft of a bicycle, and .tdmitted to probation on the usual terms. One was that he paid £5 towards the cost of the prosecution and the other was that he reported himself regularly. Ho has only paid £2 in connection with the first condition, and has not reported himself since last December. Consequently, he was arrested at Eltham for failing to comply with his license, brought before the Magistrate there, and remanded to Wellington. When he appeared before Mr., D. G. A. Cooper, S.M.. his Worship said that he was quite satisfied that the Magistrate's Court had no jurisdiction. Barnes was accordingly discharged, and immediately re-arrested in order that he could be handed over to the Probationary Officer and dealt with in the Supreme Court.
