.♦ . , NEGLIGENT DRIVING CASE DISMISSED. The monthly sitting ,of the Petont Magistrate's Court was held to-day, be. fore Mr. D. G..A. Cooper, S.M. As the result of an incident which occurred in Ja«kson 'Street, Petone, 'on. Sunday evening, 22nd February, John Nankivello appeared to answer two charges : (1) being drunk while . in charge of a horse, and <»rt, and (J&) negligent driving. Mr. P. W. Jackson appeared for the accused. The' circumstances of the ihcuknt; as related by Constable Carmody, wera that a ' meeting of the Salvation Army was being held in Jaeksoii'street at about 6.30 p.m. on the day in question. He saw the accused driving down tbe etroet at a slow pace, and a few minutes- later NAnkivello drove into the Salvation Army ring, with tlie result that otiu man was injured. Accused made no attempt to pull to one Bide. He was positive v that Nankiveite was very drunk. Witness did not remember the injured man saying that it W36 purely an accident. W. B. Gougfc And John Hnltqust, Salvationists present at tho time, gavd thoir veraion of the occurrence. They aseerted that.Naiikivilfo could not ha.v« got paat. GougJi said that accused had the appearance of being the worse for liquor. Giving evidence on, Ws -own 'behalf, Na«kivtfl&, admitted. th« ocotaroncc. Hg stated, however, that it was purely an accident, and that •bh* Ihotse had become restive on seeing som© children nth in front. Ho denied absolutely tlm.b ho wae drunk, having only had one drink tbat day. Evidence, mainly corroborative, was given by the other occupant* of the cart. On the first charge, Nankiville was fined 11s, with costs 10s. The' sec* ond information was dismissed.
