A judgment' of importance to \Vcsf> Coast lessees was dcliveicd in the Magistrate's Court in the case Public Trustee v L'harleb Audiew*, a, claim for £32 13*ad lor rojdlty paid to dofeintauU loj ?tone taken ou land leased Iroin, the I'ub'itj 'J nibtce. Tho Magistrate held Lh-it the btono'wjs leserved to the Public J nibtoc, as part of the soil, and in the lease, and the royalty of 3d per yard was L'eceived on behalf of the Public Trustee, t'.e assessed the value of the stone in the river at one-third, and the surface :lamages at two-thirds, and therefore jave judgment for the Public Trustee lot me- third of the amount claimed, viz., ClO 17s 10d, and costs £5 2s. An ippeal may be lodged.
