JUDGMENT IN TEST CASE. An interesting decision on a point ot law was delivered by Mr. E. W. Burton, S.M., to-day, in a civil action, in which the Stewart Timber, Glass, and Hardware Co., Ltd., sought to recover the sum of £22 12s 6d from the Canterbury Steamship Co., as the value of thirty-five pieces of timber short-dc livci'ed from a cargo of 6409 pieces re ceived by the defendants on board their steamer at Hokianga, for delivery to plaintiffs. The defendants contended that the Harbour Board was liable for any loss of timber that might have occurred. His Worship held that as there was no tallying by the board ' 3 wharfinger until he delivered tho goods to the consignees, and that tally showed thirty-five pieces short', the board could not be held responsible. Judgment went for plaintiffs, with costs. Mr. T. C. A. Hislop 1 appeared for the plaintiffs, and Mr. D. D. Jackson (who was granted leave to appeal) for the defendants,
