MARRIAGE SETTLEMENT

DECISION RESERVED IN HARDING CASE. Hearing was continued before his Honour tho Chief Justice (Sir Robert Stout), after Tho Post went to press on Saturday, in iho caso in which tho Official Assignee proceeded against John Whito Harding, bankrupt, in an endeavour to set aside tho settlement of certain properties by tho defendant on his wife. Mr. C. P. Skcrrett, K.C., and with him Mr. Welch (Wanganui) appeared for the Official Afc6ifrnee. Tho defendant was represented by Sir John Findlay, K.C., and with him Mr. W. A. Sim and Mr. AUison, Wangnnui. _ Witness (Mrs. Harding) was crossexamined at considerable length by Mr. Skerreth Evidence wa* also given by Thomas Allison, solicitor, practising at Wanganui, as to Mr. and Mrs. Harding (who wore then not married) having waited upon him, and witness at thpir request drew up a deed settling certain of the properties on Mrs. Harding. Witness, beforo executing the deed, questioned Harding tie to his position, and received the assurance that he was perfectly solvent. Harding handed him a balanoo-shoet, which appeared to have been prepared by Mr. Baesett, disclosing a surplus of £1000 .without taking the properties settled on Mrs. Harding into consideration. Witness recognised that he was acting for Mrs. Hnrding, and that tho settlement was for her protection. Ho told Harding, as far as ho recollected, that he (witness) would see that he (Harding) carried out tho terms of settlement. Two days later tho parties were married.
