M'Grath in the Magistrate's Court yesterday, in defending Geo. D. Watson, charged with failing to attend a parade, as required ,of him undou the Defence Act. A sergeant-major gavo^ evidence that tho defendant had not attended any drills since the onmp in May last. Counsel contended that the case must fail, because there was no proof of service of the notico on the defendant, calling upon him to attend the parade in question. The evidence of tho prosecution stopped short at the fact that one of tho officers had received instructions to send the notice. Thoro was no proof that this instruction had been complied with. Mr. M'Grath contended that the action of the Department in prosecuting Watson was tantamount .to a gross breach of faith. The defendant gave evidence that he was a tram conductor, and that in May last ho attended the annual training camp. There he acted in the capacity of an assistantcook, and under an arrangement made with Captain Hawthorne he was, in consideration of this fact, to receive Is per day extra. Tho officer promised that if 110 served in this capacity during the whole of tho camp the work would count as one year's training. Ho would thus not have to attend drill for another twelve months. Watson Btated that he had fulfilled his part of tho agreement, and since returning from tho camp ho had not received any notico to attond drill. Tho "Magistrate (Mr. W. Ok Riddell, S.M.) hold, that the defendant could not bo ' convicted, and accordingly dismissed the information.
