The decision of "the Full Court upon two questions of practice was delivered by Mr. Justice Sim yesterday. Tho Bench hearing the cases comprised the Chief Justice (Sir Robert Stout), Mr. Justice Denniston, Mr.- Justice Gooper, Mr. Justice Chapman, and Mr. Justice Sim. Tho question was whether Wanga. nui or Palmerston North was the most convenient place for hearing Supreme Court cases in which the parties are residents of the same town on the' Main Trunk 'line. In a recent case of Scott v. Gallagher, in which the parties both reside at Utiku, Mx. Justice Chapman held, that Palmerston North was tho town most convenient of access from the residence of the defendant as laid down in Rule 7. The determining factor in deciding PaJmcrston North as against Wanganui was the convenience of the times of arrival at Palmerston North of the Main Trunk through train from Auckland to Wellington. A motion to review "this judgment was filed by Scott, and in consequonce the question was opened up again before the Full Court. Mr. L. Cohen, of Wanganui, appeared, for Scott; and Mr. W. H. D. Bell for Gallagher. In a second caso in which the same point was involved the- pnrtieß were A. Merson and Co., land agents, and J. S. Walsh, farmor. of Ohakunp. Mr. C. C. Hutton, of Wnnganui, appeared for' Merson and Co., and Mr. A. R. Meek appeared for Walnh. The Court, in judgments delivered by Mr. Justice Sim, dismissed tho application for a review of the Scott-Gallagher case, but refused to order that the venue in the second case be changed.
