LICENSEE'S APPEAL
Mr. Justice Chapman heard aft appeal yesterday lodged by Susan Dorrefi Williams against her conviction by Mr. W. G. Riddall, S,M., of permitting drunkenness in Barrett's Hotel, of whion blio was the licensee. The alleged broach Was 1 committed on 17th June, 1910. Mr. A. W. Blair appeared for the appellant, und Mr. H. H. Ostler for the Crown. Tho .grounds of appeal were: — (a) That there was no evidence of j permitting drunkenness; (b) that' the Magistrate wa3 erroneous both in fact and law in finding that defendant .was guilty of permitting drunkenness; (c) that the Magistrate was wrong in law in holding that it was tho dtlty of the barman, if only a few persons were in tho bar, to at once eject the drunken man; (d) that even a drunken man Wns entitled to a -reasonable opportunity of leaving the bar peaceably after being ordered to do_ so ;, (c) thai in order to constitute "permitting" there must bo some evidence of supplying liquqr, ]or other evidence of connivance on tho part of the licensee or his servants.
