A QUESTION OF PROMISSORY NOTES. In the Magistrate's Court this afternoon, before Mr. W. G. Riddell, S.M., further evidence was heard in the case in which Thomas Duffy was charged with having obtained goods to the value of £70» on 2nd August, from Norman Edward Aitken, of Wellington, with intent to defraud. Chief Detective Broberg prosecuted, and Mr. A. Dunn appeared for the defence. Accused, giving evidence on his own behalf, said he agreed to purchase Mr, Aitken's business through an agent — Mr. Horrocks— for £140 — £70 down, and the balance in promissory notes. He paid the £70 deposit, before the agreement was executed. He understood that possession was to be given at once. Mention had been made of his father endorsing the promissory notes. About the I time of the purchase Horrocks said that it did not rnaiitea 1 who endorsed the notes as. long ac it was some one financially sound. He (the accused) had every neason to believe that his father would back the 'notes ; his father had said he would assist him up to £50, £60, or £70. Eventually they had a v> tiff," and his father said he would not sign the aiotes. He then got his brother to endorse the notes, and handed them to Aitken. He made no reference to the endoxsemeht, when he handed them to Aitken. He never said or r-opresented thatt his father i had signed the notes. He was in. possession of the business from the 2nd to the 18th August. (Left sitting.)
