VARIOUS' JUDGMENT SUMMONSES. Albert Thnmas Almond appeared in • the Magistrate's Court this afternoon, before Dr. iVl'Arthur, S.M., on several judgment summonses, the. claims aggre- . gating about £80. The cases against " him had beenradjourned from period to period, since last October,, and considP eration of his position had been finally . deferred until to-day. Mr. Hindmairsfa, who appealed for ;judgment debtor, in explaining Almond's: jposition, aa*d that the expenses of running the Trocadero were being borne by Mr. Pinnock, of the Commercial Hotel. ,'Mr. Pinnocic was also receiving the reAvenue. He had promised defendant £5100 3to assist him to carry on himself. Counsel urged that no good purpose could be jserved by forcing defendant into bankiruptcy. Dr. M'Arthur ; Is this court here to jkeep business men who are in difficulties jso that they can evade their creditors? '.It's the best thing that can be done to smake him meet his creditors. Mr. Hindmarsh : But, your Worship, no estate to divide, and his »creditors ha*e not Wing to gain. If umeans he wall have to go to gaol. Dr. M' Arthur: H» won't go to gaol." j;He knows too much for that. Henry Ivo^y, accountant to defendant,jtsaid that he last -wenffc -through the books*fchree months ago, when he found Aljtinond was not financial. For the last ssix weeks, from the beginning of De--icember, the expenses of running the ''Trocadero <had been £538, and the ■•i^evenue £959, leaving ( a surplus of £421. "Yjast March defendant had purchased the lease of the propeiSy for £6000, of ■wkich lie had paid off £1100, including the* £421 surplus. Mr. Pinnock held a bailment for the residue, and under arirangemeat he was obtaining the stores, jas defendant could' get no credit. Two' vases were struck out, owing to no apsjpearanoe of creditors. Penalty for default w»s fixed in each case. Some«of the plaintiffs were representved by .Messrs. Dix, Anderson, and f^Wedde.
