fBT TELEGBArH — PBESS ASSOCIATION."! , DUNEDIN, 9th December. The Arbitration Court gave an award in the case of Buckland v. Murray Roberts, heard to-day. The plaintiff alleged that' while worjeing as a labourer in a grain store, he was assisting to lift a bale of corn-sacks on to the dray, ' when he was subjected to a heavy strain, [ which produced aneurism of the aorta. The medical evidence was reviewed, and the court held that the existence of aneurism had not been shown. It showed, however, that plaintiff suffered from neurasthenia, and the question was whether this came from the accident. The court thought this must have bpen 1 caused by the accident, which happened in April. Plaintiff had worked since the November previous, and -if he had heart trouble he would not have been able to do the heavy work of a labourer in a | grain store. After the accident he was • i not well, and suffered from occasional giddiness, and ultimately had to give up' work. Plaintiff was awarded a lump sum of £50, with cost* £10 10s, and disbursements. In the ca-se of Simmons v. Lambert Bros., pottery works proprietors, it was stated that plaintiff in July last was tipping clay into rollers, and while endeavouring to take out a stone with a hook his right hand got into the rollers and was injured. The de•fence was that there was serious and wilful misconduct in not stopping the machinery when removing stones. The court held that misconduct was not proved, and plaintiff was therefore entitled to compensation. He lost two joints of the index finger, and tho second and third fingers are now so stiff and contracted as to be useless. Judgment was that plaintiff must submit to curative treatment recommended by two medical witnesses, and in the meantime he will be allowed compensation of £1 2s 6d per week till further notice of the court. .
