BOTTLE LICENSES. A COMMITTEE DECLINES TO HEAR APPLICATION'S. (By Tiukjkaph. — Special to Tins Post.] DUNEDIN, This Day. The elected members of the Dunedin Licensing Committee yesterday declined to hear the applications for renewals of bottle licenses, intimating a doubt as to their jurisdiction to deal with them, their ground for this decision being the proviso in the 190S .Vet, stating that nothing therein should be construed as a recognition of the lawful existence of bottlo licenses. The legality of these licenses was first questioned in 1896, because of a section in the 1895 Act whicn iaid : ""No new bottlo license shall be granted within any licensing district after the commencement of this Act. ' The dispute went to the Supreme Court, md Mr. Justice Williams held that these words did not imply that existing bottle licenses should not be renewed, but only that no fresh one could be granted after the passing of the 'Act. This decision has never been questioned till now, and, more than that, has received legislative recognition in the Licensing Act of 1904Mr. Solomon, m arguing the case yesterday for the applicants for liceaises, reviewed the whole position at length Ho pointed out, amongst other things, tiiat the 1908 Act was only a consolidating Act, under which the provisions made by previous enactments in respect of bottle licenses remain in force, and that the fact that a proviso was inserted that bottle licenses should not be granted in prohibition areas, implied that they should be granted in licensed ureas. A mandamus is to be applied for to compel the committee to renew existing licenses.
