On a judgment summons Arthur Beechey was ordered to pay Forde aod Co. £o 3s 6d on or before 16th March, or in default undergo seven days' imprisonment in Wanganui gaol. Before Dr. M'Arthur, S.M., to-day, Wm. Webb, cab proprietor, sued Michael Lane, cab proprietor, for a sum of £15 — £5 wrongful detention of a horse, and £10, tore value of the animal. Evidence had been called previously. The defendant's counsel contended that Webb obtained the defendant's horse from the pound by paying 16s 6d, poundage fees, on representing to Lane that the horse, which had been injured, was in a bad state. An hour after Webb took the animal home, said counsel, Lane visited plaintiff's stables and took the horse, which was not nearly so badly injured as plaintiff had made Lane believe. Next morning the defendant put the horse in a gig and drove it to Maranui and back." For the plaintiff, Mr. Toogood denied these allegations. Lane had asked Webb about, the horse's condition, and the latter had merely answered his questions. There was no misrepresentation on his client's part, and that being so, the contract should hold good. His Worship reserved his decision till 11th March. In the case Mabel L. J. Lane v. Wm. Webb, a claim for £11 10s, in which evidence had been taken previously, decision was also reserved. Mr. M'Orath appeared for Lane. In a case heard before Mr. W. G. Riddell, S.M., Stanley Chisholm, clerk, was sued by John Nicol, plumber, for £13 15s,' for some plumbing work said to have been performed by plaintiff at Chisholm's house in Island' Bay. After hearing evidence judgment was entered for defendant, with costs £3 7s. Mr. Anderson appeared for plaintiff, and Mr. Neave for defendant.
