SUPREME COURT ACTION. The cas-e of the New Zealand Farmers' Co-operative Distributing Company, Ltd., v. The King, a claim for £1000 damages and an injunction in respect of the operations carried on by the State Coal Department, and the alleged damage to plaintiffs' premises, was further heard to-day in the Supreme Court, before his Honour Mr. Justice Chamman. Mr. Skerrett, K.C., with him Mr. Luckie, appeared for plaintiffs, and Mr. Bell, K.C., with 'him Mr. Fitzgibbon, for defendants. A. Leigh-Hunt, manager of the plaintiff company, recalled, said his firm had had a good year's business, apart from the loss of rent. A net profit had been made for the year. Over the last half yonr, in consequence of the company having to pay double rent, there had been a small loss. Several witnesses were called toprr-e that' the coal dust from tho State y;v ds created a nuisance. In opening the defence, Mr. Bell applied for a nonsuit. Ho also reviewed at length the facts which he brought out the previous day in cross-examina-tion. Evidence for the defence was then called.
