A special case between the Trustees of the Heath Estate and the Commissioner of Taxes was heard in Banco this .afternoon, before Mr. Justice Cooper. La-nd, it seemed, was sold under agreement and less than 10 per cent, was .paid by way of deposit. In September, 1907, the purchase was. completed, and in October, 1907, a taxing Act wa* passed varying the mode of assessing the interests of vendors and purchasers- under agreements. This Act imposed an additional graduated tax on owners, • and the question was: whether the vendor* were owners on the 31st March< ,and so liable to graduated tax. Mr. /H. D. Bell, K.C., appeared for the Commissioner of Taxes, Mr. Hislop and Mr. Johnston for the trustees. The case had not concluded wifen The Post went to press.
