ARE WAITRESSES SHOP ASSISTANTS?

An information laid by an Inspector of Factories against George Pinnock, of the Trocadero, charging him with having failed to allow certain shop assistants (waitresses) a half-holiday in the week ending 24th August, 1907, was ds cided by Dr. M'Arthur, S.M., this morning, when ho imnosed a fine of £2, with costs. For the defence, saiJ his Worship, it was contended by Mr Herdman that, tho defendant's establishment was not a shop, and that thcreforo tho persons named in the infoi-mu-tion were not shop assistants. Ho further contended thafc upon an examination of tho provisions of tho Act, the establishment did not como under the provisions, but was exempt. 'His Worship said it was given in evidence and admitted by the defendant that, meals were supplied at all hours in the establishment from 6 o'clock a.m. till midaight. The definition of "shop" wat, any building or place in which goods wore kept or exposed 6r offered for sale. Defendant did not come under soctiou 4, and counsel contended that as he supplied lodging as well as moals, lie did not come under section 15. His Worship hold that defendant's establishment was a refreshment room, and did not chance its character by reason of the fact that lodging was supplied. A fine wns inTposed as already staled. On the application of Mi. Herdmau, security for appeal was fixed. Mr. Stout appeared for the proseoulion.
