Andrews, details of which havo already been published, dragged out another Stage' of hearing before Dr. M'Arthur, S.M. yesterday. The testimony of tho defendant elucidated some obscure pointe in the formation of the combination to securo the carting contract for the City Council. The arrangement for division of profits was, he understood, a quarter share for onch party, but no account had been received from the plaintiffs as to the allocation of contract money, until* after the Sup:eme Court actioif. John Kcir, carrier, nnd ono of the parties to the agreement, deposed that so far as he knew the defendant had ulwuys done his fair share of tho work. On one occasion, tbo witpess told Mr Munt that ho thought he had done more that his quarter share of the work, but did not expect to receive more than a quarter share of the profits. Munt made no objection. Witness alleged that the Elaintiff company did no moro work than is ' firm. "After the Supreme Court caee, Mr. Curtis, junr., went through tho books of the City Council and assured witpess that ho thought they had got their fair quarter- share of the profits. Even after the loss sustained by having to pay costs in the action with the City Council he still believed the contiact was » profitable ope. Mr. Burke, director of plaintiff company, had given him to «6§^erstand that he was receiving his full ?ili*ter share. The case was adjourned \ySsltt inst. His 'Worship mado no order, oa tho ground that the debtor might have signed these receipts as an agent. Such, ou alteration in what is primarily a cargo ship is significant.
