Dyer, S.M., gave his decision this morning in the case against Motorman John Whitehouse, who was prosecuted by the City Traffic Inspector for having failed to pull up at Shortland-streefc stopping place on 10th July, hL; car at the time not having its complement of passengers. JliD Worship said if it v/as intended to tako up the position that no car should etop unless some ono held up a hand or did some siipuar act, then the wide.it publicity should be given to the rule. However, it was for the prosecution to prove that dofendant had the required knowledge, not for the defendant to justify his action. The prosecution had not succeeded in proving defendant know' he was required to stop, and the information was dismissed wiWiunt costs.
