[BY TIXKGRAVH. — rKESS ASSOCIATION.] HASTINGS, This Day. At the Polico Court, yesterday, four youths woio committed for trial for an offence against a girl under sixteen, years of age.
A drainage question of considerable importance to property-owners was decided by Dr. M 'Arthur, S.M., to-day, in tho case City Council v. W. It. Haselden. The plaintiffs say that towards the end of 1903 certain defects were discovered in the drainago of the premises known ,as 92,, Molesworthstrcet. In exercise of its powers vested in it by section 274 of the Municipal Corporations Act, 1900, 'the plaintiff Corporation, by notice, required tho defendant to do certain work within thirty days. The defendant failed to execute the work ; the council caused them to bo done, and claimed the sum of £25 Os 6d, together with a percentage for supervision and interest on tho cost nt the rato of 6 per cent, per annum. For the defence, it was contended that the notice was given under the wrong Act, and that this wa3 false, inasmuch as a proper notice Avan a condition precedent. His Worship, in the course of an exhaustive judgment, upheld this contention, and expressed the opinion that the defendant was entitled to rely upon the proviso in section 7 of the Wellington City Drainage Empowering Act of 1894, which provides " that nothing herein contained shall authoriso the council to charge any owner with the cost of constructing and laying any new drain in place of or making any alteration or addition to, any drain, which, on or subsequently to the month of July, 1890, was laid in accordance with tho bylaws of tho city for tho timo being in force." Judgment was 'for defendant, with tfye usual costs. Mr. 11. D. Bell appeared for defendant, and Mr. O'Shea for the Corporation. The latter was granted leavo to appeal. Our Dunedin correspondent telegraphs to-day : — "The Bowling Association has negatived the proposal thit this year's tourney should begin on 27th December in lieu of 'tho middle of February." Tho Hon. W. Hall-Jones passed rather a restless night, v but we are assured that his condition is much better than it was a fow days ago. All the matches nnunged for last ■Saturday by the Wellington Ladies' Hockey Association, and which wero postponed on • account of wet weather, will not be played until tho end of the first round of fixtures. Next Saturday the matches originally drawn for that day will bo played. , A concert was held at tho Sailors' Rest last night. Items were contributed by the following : — Missos Cimino, A. Twohill, Asher, Smith, M. Twohill, Katmcen Twohill. Anderson, Messrs. W. Parata, Gamble, Smith, R. Parata, Parfitt (3), and Twohill. The proceedings were brought. to a conclusion by a Maori haka. H Miller, "Fairviow," off Hawkcr-Bt , to-morrow, commencing at 11 a.m. Full particulars aro advortised in our auction column*, and catalogues will bo posted Ig nny address on application. To-morroW, at 2 p.m., on Iho premises, No. 1, Oak Grovo, off Hankoy-Btreot, Messrs. J. H. Bothuno and Co. will soil housohold furniture, contents of tho abovo residence. Tho furniture will bo on view to-morrow morning.
