A jury of twelve was empanelled Defore Mr. Justice Cooper this morning to try tho case of Hay ward's Land Company v. Patrick Leahy Hartnett, an action to recover £1440, and secure an injunction for alleged misrepresentation. Mr. Gray is counsel for plaintiff, and Sir. Skerrett is for the defence There were negotiations between defendant and certain persons who ultimately became the plaintiff company, to acquire certain land in the Hutt valley, and it is alleged by the plaintiff company that defendant represented there were 132 acres of grass land lying between the road and the river. Contest is made of this point. .After hearing of the case had proceeded for some time, Mr. Skerrett raised a non-suit point on me ground that plaintiffs' pleading did not disclose a specific offence. Mr. Gray asked leave to amend, and proposed to add specific instances in regard of allegod fraud land misrepresentations, which were not made clear in tho original pleadings, giving dates and particulars. Mr. Skerrett objected to these amendments being allowed. Eventually his Honour gave permission for the amendments, conditional upon plaintiff company paying twenty guineas costs to defendant, plus witnesses' expenses, the case to be adjourned for further hearing until the next sittings of the court. Mr. Skerrett then intimated that he might be disposed to accept the amended pleadings and proceed with the case to-day, rather than havo his client inconvenienced in regard to the land, as would be the case if the further hearing was hung up for some months. His Honour, to allow time for consideration, adjournea the case until this afternoon, "Warning to vagrants !" in heavy black type makes a startling line on a placard which a reporter noticed on a shelf in the Tourist Office this morning. The notice, however, has no application to tourists. It comes from America,, and is merely" another example of "the way they have in the States." "Warning to vagrants !" the announcement runs : "Any person or persons found loitering around any street, alley or Northern Pacific _ right-of-way, or 'any public placo within the city of Dickcnson, who cannot givo a good account of themselves, or snow visible means of support, will be put to work on the streets with ball and chain.
