Widdowson, S.M., gave his reserved decision in the caso in which tho Commissioner of Taxes sued the Presbyterian Church Property Board for taxes duo on a reserve held by the board. For tho defence it was contended that, as tho proceeds from the land •were- devoted to a theological college, which is not carried on for pecuniary profit, and is open to all, the property ■was not liable to taxation. 'His Worship decided that neither the boar.d nor th© college is a public educational or a public charitable institution, and the land is therefore- not exempt from taxation.
