At the Auckland Police Court Arthur Oeave wag charged with committing a breach of the Auckland city bylaws by leaving 'a motor cax standing in VuleanlaHe on 19th May. He pleaded not guilty. -The evidence showed that the car -was left standing in the lane from 9.50 to 10.3 a-m., the lane being obstructed. Mr. Hacketi:, who defended, raised a technical point that the bylaw wa3 unreasonable and bad. He contended that under it .no tramcar could come .to a, stop tlo pic,k up or set down passengers, and no drive* of any vehicle could stop even ior a moment. His ' Worship : Everybody \i ould have to keep going for ever under your argument. You contend that no vehicle -can become stationary in a public -place. Mr. Haekett : Yes. His Worship : I don't think it means that. The bylaw has to be construed reasonably. He added that he might be quite wrong in his view, but he held that the bylaw was valid. He would give every facility for taking the view of the higher court if defendant chose to appeal..' . .
