Leahy, Soerotary of tho union, on tho informutiof of Clough, was lined for refusing to givo evidence before the Commission. Tho New South Wales Full Court decided against tJio fino on tho ground that the Commission was illegal. The High Court reversed that decision, and Leahy sought leave to appeal to tho Privy Council.
