A meeting of meuibu-s of the Kelburno Ratepayers- 1 Association was held at Mr. R. C. Hamerton's residence on Monday evening. The meeting authorised the formation of such a brigade, and those present agreed to bear a proportion of the co?t of maintaining the brig\de, building a shed, and purchasing a ».k'am whistle, or syren, for alarm purposes. The brigade will consist of some eighteen members, all volunteers, and tho City Corporation will supply a chemical engine, ladders, axes, etc. The question of the insuraaco of men against accident was gone into, and it was decided such an insurance should be obtained. Tho Chairman (Mr. R. C. Hamerton) gave a resume of events since the la&L general meeting, six months ago. It waa resolved thivt tfae financial year shouH close at the end of Decembi-r in each year, and that the general meeting should be held before the 15th January in each year, at which the whole of the committee should go y out of office, giving the ratepayers the right to elect either the old committee, or others, as they thought fit. The annual inspection of the Petone Naval Artillery^, required by section 52 oi the Defence Act, w.as held at Petone Drillshed last evening. Although the weather was most unfavourable there was a splendid muster, only ten members failing to answer at roll-call. Of these, two were sic/k, one was absent in the country, and three were detained by their employment, leaving only four unaccounted for. The Act demands that these four, unless a good excuse can be shown, must pay a fine of £1. Officers absent are liable to a fine of £5. The present strength of the company is 87. Lieut. -Colonel Campbell, commanding the Wellington Division of Garrison Artillery Volunteers, assisted by Captain Biss (Pay and Quartermaster) examined all Government property on issue to the company. Deficiencies and worn-out stores were noted, to ue reported to the Department. Notice was given of a Church parade at Petone next Sunday. On Saturday the annual sailing race with the Wellipgton Navals, for the Ship Zealandia Cup, will take place. On the following Saturday the rowing race for company prizes will be held, and every Saturday there will be rifle-shooting at the company's private range at Kaiwarra. It has also been decided to hold the usual cruise in Queen Charlotte Sound during Christmas week. The half-yearly meeting of the Excelsior Lodge of Druids was held on Monday evening, Bro. Isaac Clark, A.D., presiding. The report and balance-sheet showed the lodge -$o be progressing" in a satisfactory manner, the membership having, increased by 13, and the funds by £135 during 'the half-year. In response to an invitation by the Mungaroa Lodge it was decided that the officers elected for the ensuing half-year attend at the Upper Hutt Lodge . on Saturday, 17th inst., for the purpose of tasking part in the public installation of officers. A: Black, dentist, recently proceeded at the Magistrate's Court against Walter Gotch (otherwise known as Professor Linguard) for the recovery of £10, being the deposit on a lease of certain premises in Hume's buildings. It appears that Gotch occupied the, premises, and agreed to sublease them 'to plaintiff. After the deposit had been paid Messrs. Hume and Son refused to consent to the transfer, alleging as a reason that they did not wish the premises to be let to a dentist, and that they would consider the plaintiff to be a trespasser if he entered into possession. The memorandum of lease by the lessors to defendant set out that defendant should not assign the premises without their consent in writing — such consent not to be arbitrarily ivithheld if a solvent and respectable person was obtained. Plaintiff alleged that if he entered upon the premises he would run the risk of an action for ejectment, and, further, would not get a proper title to the "transfer of the lease. He therefore cancelled the agreement and claimed to be repaid the deposit. His Worship held that Messrs. Hume and Son were bound not to reasonably withhold their consent ; that the defendant's agreement was binding on the plaintiff, and hence if the plaintiff failed to carry out his part of the contract he could not claim a refund of his deposit. Judgment was accordingly for the defendant Gotch, for whom Mr. yon Haast appeared, with £1 3s costs. Mr. Buller represented the plaintiff. A claim for £62 was yesterday afternoon made at the Magistrate's Court by Ballinger Brothers, plumbers, etc.,! against Georgi W. Smart, settler, Petone,' I for eight weeks' rent and damage done to their house at Petone. Pefendant ad"mitted £12, the rent portion of the claim, and disputed the balance on the ground that the damage alleged to have been done to the property had not been effected during his tenancy. Mr. Young appeared for plaintiffs, and Mr. Luckie for defendant. After evidence had been heard at length, the case was adjourned until Thursday for argument. John L. Morrison, Petone, sued Ernest A. Moon, builder, Lower Hutt, for" the recovery of £20, commission on the sale of certain property at Petone. judgment was for plaintift for the amount claimed, with i! 3 14s costs. Mr. Young appeared for plaintiff and Mr. Bqlton for defendant. Sitting in his civil jurisdiction at the Magistrate's Court yesterday, Dr. A.
