Mr. Justice Williams dismissed the appeak of Captain Fleming, Mercantile Superintendent, against the Magistrate's (Mr. Graham's) judgment in acquitting the captain of the Westralia on a charge of a breach of the Act by carrying nine firemen and six trimmers, instead of nine firemen, three trimmers, and three greaseis.
