Very heavy weather hnmpored working operations between Australia and New Zealand. The Sherard Osborn leaves to-morrow for Syduey direct, thence to Tasmania and back to Singapore, overhauling the cable en route. A supply of bunker coal will bo taken on board at this port. Captain Madge, who was in cbargo lnst voyage, lias retired, and Captain Dumvall, the former chief officer, has been promoted to tho command of the vessel. The news of the safe arrival of the s.s. Waiwera with the second New Zealand Contingent at Durban, after a smart passage, extending over four weeks, will be received with gonoral satisfaction. The fact that only four horses have been lost on the trip between. Albany and Durban points to a fine weather passage, and great care on the part of those on board, and also gives hope that the remaining animals will be landed in good condition. The cable message to-day states that "our boys" are at Durban awaiting orders. In the present condition, of things at the . different centres of activity at the seat of war it is difficult to tell where the Contingent will bo first called upon to serve. It may land "at Durban and be attached to General Buller's force ; ' thero is the alternative of it being more urgently yequired in Northern. Cape Colony, where the first Contingent has distinguished itself, or it may have the luck to be called on to form a unit in the force with Lord Roerts, now invading the Free State. This is, of course, pure speculation, but looking at events as they appear from this colony it seems more likely that they will be Bent to Northern Cape Colony. The reserved judgment of the Magistrate in the action J. Ashcroft v. F. C. W. French, a claim of £131 16s 7d, which has been looked forward to with great interest, was delivered to-day. Plaintiff was the appointee under the Administration Act, IbBB, of the estate of Thomas Baker, deceased, who died 18th January, 1899, his will being proved on 13th March, 1899, by defendant, who was the executor. Plaintiff was appointed to administer the Act on 18th July, 1899. Prior to that appointment defendant had collected the assets of the estate and in good faith had paid various sums due for wages amounting to £157 8s 3d. Defendant treated these claims for wages as preferential cairns, and paid them in full, though he knew there was insufficient to pay the rest of the creditors in full. Plaintiff then claimed from defendant £131 16s 7d, being amount paid away less a dividend of 3s 3d in the £. , There appeared to the Magistrate to be two complete answers to the action. First, all the creditois of deceased were of equal rank, and the executor could pay them in any order he chose, and consequently prefer one creditor to another, and cou'.d on paying away all the assets in his hands plead plene administravit to, any action brought against him. Secondly, the Administration Act (section 14) provided that nothing in that Act should invalidate any payment made or any act or thing done in good faith by the executor or administrator before the time when notice should be given to him that it was intended to apply for administration. It was admitted in tnis case that the payments were in good faith, and before any notice as aforesaid. Judgment would be for defendant (for whom Mr. Tripp appeared) with £6 11s casts. In his civil jurisdiction this morning the Stipendiary Magistrate gave judgment for plaintiffs in the following cases : —Commercial Agency v. W. D. Scott, £12 16s 8d; same v. W. E. John Winters, £18 14s 6d ; Wellington Trust, Loan and Investment Co. v. Mere Ruiha Hakaraia and Hakaraia te Whena, £20 3s 6d ; Wairarapa Farmers' Co-operativo Association v. William Gwilliams, &)1 12s 6d ; Levin and Co. (Lmtd.) v. Jacob Bittlemeyer and Mendus Hallberg, £26 14s 9d. Judgment summonses — J. J. K. Powell v. Stanley Smith and others, balance of £12 Is 6d, to be paid by instalments of 10s a month ; E. Ambler v. Robert Matson, sen., £21 17s 6d, order, for payment of 53 a week or in default 22 days' imprisonment. The attractions of Mr. Martin's blackberry grounds at Kaitoke are well-known to many residents of Wellington, and as the crop of fruit this year is said to bo a heavy one, the grounds will no doubt be well patronised.
