Constable William Eccles (respondent). This was an appeal from the decision of Mr. Hutchison, S.M., convicting M'Veigh, a. hotelkeeper, of selling liquor to a person already intoxicated. The information was laid by Eccles. Mr. Bautne appeared for the appellant, and Mr. Tole (Crown Solicitor) for the respondent*. Mr. Bourne said the whofe cose turned on the question of whether knowledge on the part of the landlord was a necessary ingredient of the ques- '! tion of knowledge. The fact of the person being served being intoxicated was hot at all essential. He considered the appellant should succeed. Mr. Tole contended that the appeal must be • dismissed. His Hohour said he would take time to look into the case and authorities. Judgment was deferred.
