In the matter of the TramWays Act, 1894, and the Wellington High Levels Tramways Act, 1898. NOTICE is hereby given that it is tho intention of tho Council of tho City of Wellington to apply for an Order-in-Council authorising the Construction of a Tramway from a point on Seotion 481- on tho plan of the City of Wellington, about 2 chains west of Lambton-quay, to tho western boundary of the uity of Wellington in the Botanical Gardens. Arid also tb delegate the authority conferred by the said Order to the Kelburne and Karori Tramway Company (Limited). Plans and cross sections showing the nature of tho works proposed to be undertaken, together with a description thereof, have this day been deposited at the office of the Town Clerk at the City Council Chambers, Bran-don-street, and are there open for public inspection during office hours. The following is the nature of the proposed works. The proposed Tramway will be situated within the Borough of the City of Wellington. The lower terminus of the Tramway will be built on Towiv Seotion No. 4-84, at a point about 2 chains to the west of Lamb-ton-quay, and adjoining the New Zealand Times building. From the lower teiminus on Section No. 484 the Tramway, consisting of a double line tif rails, will be constructed generally as Bhown on the said plans and sections. It will pass in a tunnel about 20ft wide under Wellington-terraoe and under Section 460, and will emerge into the opou near the south-west boundary of Seotion 460. The Tramway Will then cross the gully in Section 459 on a viaduct, and will pass under the street at Clifton-terrace, and under Mr. John Jack's land in a tunnel. Through Mr. Littlejoha's land— that in, a part of the Hospital Reserve— >the lino vill pass in open cutting, and will' then cro&s Botanical-road on a viaduct. From there it will pass in tunnel under Mr. M'Ardlo's and Mr. Martin Kennedy's land to Kelburne Park. Through the northernmost corner of Kolburne Park, and over Salamanca-road, tho line will pass on a viaduct and thence in open cutting through Seotion 10 of the Hospital Trustees, and on viaduct through Section 17 and over the Botanical Garden road. Thence partly on viaduct and partly in open cutting through the southernmost portion ~of the Military Reserve to the upper terminus of the tramway in th 6 Botanical Gardens. The Tramway, with a double line of rails, will be laid in a straight line throughout on a grade of abdut 1 in 5 to the upper terminus. From there it is proposed to extend the rails on a level grade' for a distance of about 3£ chains to the western boundary of the Botanical Gardens, which is also the weßtern boundary of the Borougli of Wellington. It is proposed to work tli6 cars on this Tramway by means of oablo traction. The following is a general description of the terms and conditions subject to which such delegation is to be made'! — 1. That the Company will substantially commence the conßtfu6tibn of tlie * Tramway within three moiithd from the date ot the Order. 2. Complete and finish the said Tramway within two years from the timo of the substantial commencement thereof, and perform and keep all the terms and conditions of th^ Order. 3. Allow the Council and Its authorised officers to inspect the Tramwny and rolling stock. 4. Will not assign, lease, or mortgage the undertaking without the consent bf the Council. 5. Will pay and discharge all compensation or purchase money or danvage's or other sums of money awarded or agreed to ba paid o< given or atljuflge'd In favour of any person or persons for of in respect of any land, subsoil, buildings, or improvements or any int&rcsb therein taken or purchased arid all damages 6fid mo'h'e'ys adjudged cv pdyable in r'espe6t of any negligence or tort in connection the constructions of any work and also all .penalties. 6.
