Evens, schoolmaster at Motupiko, Judge Robinson to-divy decided on the points raised by the defendant's counsel. He ruled tbat the words complained of wore actionable, bat held that the defendant, when called to tho mooting- of the Sohool Committee, wae on his defence, having to answer certain charges, and his acenser being piesent when it waß alleged he used the words complained of. Defendant might have imprudently expressed himself, bnt tho occasion waß one of qnabfied privilege, and the words were not uttered in malice. Tho plaintiff waf nonsuited with costs.
