|Bt Telegraph. J [united press association.] Chkibtchurch, This Day. Mr. Justice DennUton yesterday Rare judgment for defendant, without ooati, in Taylor v. Taverner, a Timaru case. The defendant is plaintiff's married daughter, and before her marriage she transferred to her father her interest in a deferred payment section at Orari. She had not carried out her obligations as selector, bnt plaintiff paid the pnrchaee money, and occupied the land. On the expiration of the term defendant obtained a certificate of title. Plaintiff now sought to compel defendant to execute a memorandum of transfer to him. The Judge held that defendant had not fulfilled her obligations as a selector or obtained the consent of toe Land Board to t>;c a jsigiiUiMit of her interest in the land. The ajsitfement v/as not vaiid, as ehe had Fct up the unsuccessful plea thai the transfer was obtained from her by fraud, and had allowed plaintiff to expend money on the land intending to obtain the benefit of it herself.
