COOPER A BACON, TRADE MARK ACT. Mrs. E. Cooper's Version : I am quite aware that Mr. Bacon was the first to register his bottles, bnt the reason he did so is beat known to himself. Waß it that he might get a lion's share of unregistered bottleß, to be need at outside places suoh as Foxton ? Mr. Bacon tells an untruth about one dozen bottles being Bent to Karori, for there was two dozen ; I have witness to prove it. I was fined £1 and coßts for using four of Mr. Bacon's bottles — not seven as he stated. If a person is fined for naing one bottle that ia just as bad as using four bottles; and I do not think that I had any more fraudulent intent than Mr. Bacon, especially as Mr. Bacon admitted in Court that one of the bottles was closed do«n with his string, after all his men swearing that thoy had never passed any of my bottles out of the place. Mr. Bacon also rays he prosecuted me. Very reluctantly I will now give the details, and get witneßsea to what I say ia correct : — When Mr. Bacon obtained hia bottles, he came to my faotory to see me, bringing a document with him, and wanted mo to sign to pay him £50 if any one of my employes filled one or more of his bottles, and at the same time wanted me to pay for cab hire for himself and witness to Karori to fetch back those four bottles, which I positively refused to do. I told him I would, rather than do so, abide by the oourt, and refused to give him a written apology or sign any agrpement unless all the other aerated water makers combined, and then, and then only, would I sign any agreement concerning our trade mark, as I was not registered at that time. I also told Mr. Baoon that he had filled my bottles, but he defied me, in presence of two witnesses, to bring a case against him, simply because I was not then registered.
