At tho Distriot Court to-day, a role nt'tt obtained by tho Dank of New Zealand at Nelson against Mr. Hickson, liquidator in the Phoenix Gold Mining Company, oamo on for argument. Tho rule called on tho liquidator to show oauso why ho should not bo ordered to pay to the Bauk of New Zealand 4085 owing to the bank by tho said oompany, or in the alternative, why ho should not l>e removed by the Court from tho oflloe of liquidator ; and in either caso, why hit remuneration as liquidator should not bo wholly withheld, or any payment on oocount of suoh remuneration hitherto undo to, or retained by him, as snob, liquidator, should not be disallowed, and why he should not bo ordorod to pay aosts inoident to tho trial. Tho liquidator had filed affidavits stating that he looked on the Bank of Now Zealand at Wellington and tho bank at Nelson as one creditor, and, not knowing that there were sufficient unoalled-up asset* to pay all debts, ho did not think it would nmko any difference whether he paid the bank in Wellington or in N«l»on,'80>ho paid the former in full Tho affidavits replied to other allegations, but admitted that attention hod not been paid to allteohnioalitiM. Mr. Adams, for Mr. Hiokson, asked for an enlargement of the rulo for three months, in order that ho might obtain another ordor on contributors and pay the bank. His Honour granted the application, whioh was not opposed, and in doing so said it was evident that the liquidator had noglootod his dntioi.
