WELLINGTON CITY COUNCIL. BY-LAW FOR THE BE^ULVTION OF THE STORAGE OF GUN'POWDEK, NITRO-GLYCKRINE, KEROSENE, AND OTHKR l-XPLOSIVE OR DAN.GEEOUS GOODS. NOTICE is hereby given that the following By-law, which waa passed at a tpeoial meeting of the City Council, held on tbe 81st August, wjII be confirmed at the ordinary meeting of the Conncil, to be held on Thursday, the 28th September, at 7 30 p m. :— Bi-liw for Prohibiting the Carrying, Keeping, and. Storage within the Borough of the City of Wellington of Gnnpowder or any other ExplofivMaterial, except nnder the conditions and restrictions contained in this Bye law, and for Regulating the Keeping and Storage within the said Borongh of Petroleum, as hereinafter defined, and tho conditions to be annexed to any license relating to the aame. 1. For the purposes of this By-law the term "Explosive Material" shall be deemed to include Gnnpowder, Nitro-Glyoerine, Dynamite, and any other ixploaive Material, whether belonging to the classes of explosive materials hereinbefore mentioned or otherwise. 2. No Kxplosivo Material shall be conveyed by any meana from one part of the Borongh to any other part thereof without a permit nnder the hand of the Town Clerk, and Bnbject to the conditions hereinafter mentic ned, or between the hours of annset and sunrise. 3. All Explosive Materials carried from one part of the Borough to the other shall be bo oarried in a, vehicle properly oonstrncted to gnard against oononssion, and approved for that purpose by the Town Clerk, and covered with a tarpaulin having the words " Explosive Material " painted in large and legible characters on the outside and at both aides of the said tarpaulin, co as to be plainly legible whilst Buoh vehiole ia passing through any part of the Borough. 4. No Kxplosivo Material except in such quantity as may from time to time be authorised by permit to be iaaned by the Town Clerk in that behalf shall be etored or kept in any pace within the Borough, and when any such Explosive Material shall be intended to be stored the provisions of Seotions 7 to 14 inolusive of this By-law shall be deemed to extend to the same in Jike manner as to the oase of Petroleum, aa hereinafter defined and provided for. 5. Every person who shall do, permit, suffer, or omit any aot, matter, or thing, oontrary to the provisions of SeotiOßß 2, 3, and 4 of this By-law, shall be deemed to be guilty of an offenoe against tho same, and 'shall be liable to a penalty of not leas than .61, nor more than .65 for suoh offence, and in every oaae where suoh offence Bhall be a continuing one to a further penalty of not leaa than £2, nor more than £5 for every day or part of a day during whioh suoh offenoe shall be oontinued. 6. For the purpose of this By-law the term " Petroleum " shall include the several articles and things mentioned in Section 2 of "The Uangeroua Goods Aot;, 1869," whether the Bame or any of them shall or Bhall not give off an inflammable vapour at a temperature of less than 110 degrees of Fahrenheit's thermometer. 7. No Petroleum Bhall be kept by any person within tbe Borongh except in pursuanoe of suoh written license in that behalf as hereinafter mentioned, provided always that it shall be lawful to keep in any private dwellinghouso any quantity of Petroleum not exoeeding eight gallons for private use. 8. Any person desirous of keeping any Petroleum in or upon his premises within the said Borough, except as aforesaid, shall deliver at the offioe of, and addressed to the Town Clerk, a written application for a license to keep suoh Petroleum, and suoh application Bhall specify the situation of the premises wherein the Bame is intended to be kept, and tha kind or kinds, and the respective quantities of the same which the applioant purposes to keep therein. 9. Upon rcoeipt of Buoh application the Town Clerk shall cause an inspection of the premiaea therein named to be made by the City Surveyor, wko shall forthwith examine auoh premises and report in writing as to the fitness or otherwise to be the reoeptaolea of Petroleum, having regard as well to the obaraoter of the business oarried on therein, aa to the situation aud construction of the building, and the precautions, if any, whioh the applioant has taken against the rißk of Petroleum taking fire. 10. If the report of the City Surveyor ehall, in the opinion of the City Connoil, be satisfactory, the Town Clerk shall forthwith issue a license nnder his hand, authorising the applioant to keep auoh quantity of Petroleum as aforesaid as the City Council may consider reasonable. 11. In the event of an application for a lioense as aforesaid being made for any premises wherein other goods of any description whatever are 1 kept, the qnantity of Petroleum which shall be allowed to be kept in terms of the Baid license shall not exceed two hundred gallons. 12. Every lioense aa aforesaid Bhall terminate on the 31at day ef Maroh in eaoh year, and for every Buoh license there shall be paid to the City Treasurer the aum of five shillings for every quarter or fract ; on of a quarter of a year up to the said 31st day of Maroh in eaoh year. 13. It shall be lawful for the City Connoil at any time to oause to be' inspected any premises licensed. as aforesaid for the purpose of ascertaining the qnantity of Petroleum, for the time being, kept upon Buoh premisea ; and in oass of anyone in any manner preventing or obatruoting Buoh inspection, ho shall be guilty of an offence against thia Bylaw. 14. If upon inspection it Bhall appear that a greater quantity of Petroleum than is specified in the lioense is being kept on Buoh licensed premises, or in caso the ( ity Council shall, in their absolute discretion, consider it expedient so to do, it shall be lawful for the City Counoil forthwith to revoke suoh licenße, and to cauae a notice ef aueh revocation under the hand of the Town Clerk to be left at the premises of the licensee, and thereupon Buoh license shall be absolutely void, and of no effeot. 15. Every person who shall do, permit, anffer, or omit any aot, matter, or thing oontrary to the provisions of Seotions 7 to 14 of this By-law shall be deemed to be guilty of an offenoe Against the same, and shall be liable to a penalty not exceeding JBS .for each offenoe, and in every case wHere *uoh offenoe shall be a continuing one to a further penalty not exoeeding JBS for every day or part of a day during whioh snob, offence shall be oontinued.
