The defendat>ti denied all the material allegation set forth in the dccl .ration. Mr. Shaw, in opening the case, said evidence would be called to show that while the plaintiff was standing on deck, with his hand on the rail, a block, weighing between 201bs and 301bs, dropped from the foretopmast, and did tho injury sot forth in the declaration. A man had been sent up to remove the block while the ship was rolling in the Strait, and he, having taken no means to secure it, let it fall. It would be shown that this was carelessness, and that it was bad seamanship to have the block removed at all at sea. Evidence was then taken in accordance with the opening remarks. The evidence for the defence was to the effect that the injuries were the result of accident, and that there was no carelessness exhibited, it being customary to take down blookß by hand, as was being done when the accident occurred. The case waß proceeding when we went to press.
