TAKING OF LAND yoa thb BOROUGH OF WELLINGTON WATER SUPPLY. (1.5.) Arthur Gordon, Govsrnob. A PROCLAMATION. XTjTHEREAS by section one hundred and »T seventy-nine of "The Municipal Coi-porations Act, 1876 " (herein referred to as "the said Act"), it is enacted that the Council of a borough constituted under the said Aot may take any land within the borough for any of the purposes of the said Act, in the manner provided by the Second Part of "The Publio Works Act, 1876:" And by the two hundred and forty-fourth section of the said Act it is enacted that the Council may construct waterworks for the supply of pure water for the use of the inhabitants of the borough, or of the shipping in any harbor adjoining, and may do all things necessary thereto, and therein especially may purchase or take, under the provisions of " The Publio Works Act. 1876," land and waters within or beyond the borough: And by the two hundred and forty-fifth section of the said Act it is enacted, that any land or water so taken shall be taken under the provisions of " The Public Works Act, 1876 :" And whereas by section seven of "The Municipal Corporations Act, 1876, Amendment Act, 1877," it is enacted that the Council of every borough may purchase or take under the provisions of ''The Publio Works Act, 1876," any lands outsido of as well as within the borough for any purpose connected with the drainage of the borough, the ma'ntenance and repair of the roads, Btreets, and publio places thereof, or the publio health, protection, and safety of its inhabitants, or for any other purpoßO for whioh the Council is authorized to take land within the borough : And whereas the Council of the Borough of Wellington propose to construct the following works, viz : Waterworks for tho supply of the City of We'lington with water from a weir situated in the Wainuiomata Distriot of the Provincial District of Wellington : And whereas the Council aforesaid has laid before ma the memorial and map required by the twenty-fifth Bection of " The Publio Works Aofc, 1876 :" And whereas it appears to me that all things required by the said Aot, " The Municipal Corporations Act, 1876, Amendment Act, 1877," " The Publio Works Act, 1876," and " The Publio Works Act, 1876, Amendment Act, 1878," to be done and performed to authorize the taking of the said lands have been done and performed : Now, therefore, I, Arthur Hamilton Gordon, the Governor of the Colony of New Zealand, by and with the advice and consent of the Executive Council of the said colony, in exercise and pursuance of the power and authority in me vested by the twenty-fifth seotion of " The Publio Works Act, 1876," and by the said Acts, and of every other power and authority enabling me in that behalf, do hereby proclaim and declare that the lands described in the Schedule hereto are hereby taken for tho purpose of such works as aforesaid ; and that, from and after the nineteenth day of May, one thousand eight hundred and eighty-one, the lands described in the Schedule hereto Bhall become vested in fee-simple in the Mayor, Counoillors, and Burgesses of the Borough of Wellington, discharged from all mortgages, charges, claims, estates, and interests of what kind soever, for the purpose of suoh works as aforesaid.
SCHEDULE. A parcel of land forming part of Seotion No. 35, in the Wainuiomata District, containing 30 acres. Bounded on the eastward by the eastern boundary of the said section from a point measured 2720"7 links from the point whore such boundary joins the eastern boundary of Section No. 34, and extending from the first-mentioned point northerly to a point on the said eastern boundary 2780*8 links from the commencing point,- and being a parallelogram extending westerly from the said eastern boundary 1080*3 links on a bearing 124deg 46min from the direction of such eastern boundary. A parcel of land forming part of the said Section No 35 and of Sections Nos. 34 and 67, in the said district, having a width of 100 links, the western boundaries of which commence at the point where the southern and western boundaries of the last-described parcel of land meet, and extend from thence on a bearing 232deg 56min, 10606 links; and from thence on a bearing 240deg 49min, 568"9 links ; and from thence on a bearing 211deg 16min, 1210*2 links to the northern boundary of Section No. 34 ; and from thence on a bearing 211deg 16min, 211"1 links ; and from thence on a bearing 224deg lGmin, 438 8 links ; and from thence on a bearing 232deg 17min, 1903*3 links; and from thence on a bearing 274deg 17min, 141*4 links ; and from thence on a bearing 229deg 17min, 650 links ; and from thence on a bearing 210deg 31min, 9487 links : and from thence on a bearing 230deg smin, 2353 links ; and from thence on a bearing 243deg 38min, 519*5 links; and from thence on a bearing 254deg 56min, across the boundary of the said Section No. 31 into the said Section No. 67, 700 links ; and from thence on a bearinjr 262deg 3min, 286*3 links, to the eastern boundary of Seotion No. 26 in the said district ; and from thence southerly along the said eastern boundary a distanoe of 1008 links ; the eastern boundaries of the parcel of land now described being parallel to the western boundaries at a distance of 100 links measured easterly upon a line perpendicular to any part of the western boundaries thereof. A parcel of land 61 links wide by 500 links long forming part of the said Sections Nos. 34 and 67, the western boundary thereof commencing at a point on the western boundary of the said Seotion No. 34, 2271*1 links from the southern corner of the said Section No. 34, and extending from thence along the western boundary of the said Sections Nos. 34 and 67 500 links ; and the eastern boundary thereof being parallel to and dißtant 61 links easterly from the said western boundary. A parcel of land 25 links wide forming part of the Section No. 26, in the Wainuiomata District, and extending across the said seotion from the eastern to the western boundaries thereof, the southern boundary of whioh Baid parcel of land now described commences at the eastern boundary of the said Seotion No. 26 at a point measured 1858.6 linkß along such eastern boundary from the southern boundary of the said Seotion No. 26, and extends from thence on a bearing 87deg 27min 33aec, 34296 links to the western boundary of the said Section No. 26 ; and the northern boundary of which iB distant northerly 25 links measured perpendicularly from such southern boundary. A parcel of land 25 links wide forming part of the Seotion No. 2 in tho said district, and being a direct continuation westerly of the parcel of land lastly hereinbefore described from the western boundary of the said Section No. 26, and on the same bearing, for a distance on the northern side of 1357*3 links until it reaches a road running through the said Seotion No. 2. A parcel of land 25 links wide forming part of the Seotions Nos. 1 and 2, in the Wainuiomata District, tho northern boundary of whioh commences at a point measured westerly 1011*1 links along the northern boundary of the Baid Section No. 1 from the north-east corner thereof, and extending easterly from thence through the Baid Section No. 1 on a bearing 312deg 16min Bseo, 511*7 links; and from thence on a bearing 293deg 58min 1212 linkß, through the said Seotions Nos. 1 and 2 to the road running through the said Section No. 2 ; the southern boundary of the paroelof land now described being formed by lines parallel to and distant southerly 25 finks measured as aforesaid from the said northern boundary-line. A parcel of land containing 3 roods 16 perches forming part of the Section No. 8, in the Lowry Bay District. Bounded on the southward by part of tne southern boundary of the said section for a distance of 356' 8 links measured from the point where the northern side of the Wainuiomata Road crosses the said southern boundary; and from thence north-westerly on a bearing 312deg 16min 8 co for a distanoe of 7827 links ; and from thence southerly along the said Wainuiomata Road 540*8 links to the commencing point. A parcel of land 25 links wide forming part of the Seotion No. 7, in the Lowry Bay Distriot; the northern boundary of which commences at a point measured 980*3 links Westerly along the Wainuiomata Road from the point where the western side of a distriot road running through the said section joins the said Wainuiomata Road, and oxtending from thence north-westerly on a bearing 152deg 31min 40seo a distance of 25239 links; the southern boundary of the said parcel of laud being distant from the northern boundary thereof 25 lining measured as aforesaid. A parcel of land containing 2 acres 1 rood forming part of the Baid Sestion No. 7, Lowry Bay District. Bounded on the southwest by part of the south-western boundary of the said Bection, suoh boundary commencing at a point measured south-easterly 459*5 links from the north-western extremity of such boundary ; and from thence southeasterly 700 links along such boundary; from thence north-easterly on a bearing 246deg 24min, 642*8 links; and from thenca easterly on a bearing 293deg 51min, 950*2 links to the commencing point. A parcel of land 25 links wide, the northern boundary of which starts from a point measured 4889 links from the north-western extremity of the south-western boundary of the said Section No. 7, Lowry Bay L/istriot, and extending westerly therefrom on a bearing 299deg 4min through the Sections Nos. 19 and 16, Lowry Bay Distriot, and Section No. 21, in tho Harbour Distriot, and across
