[united pbess association.] Auckland. 7fch May. At a special sitting of the K.M. Court, the case of Fenton v. Biccardi, claim £G tis for goods supplied, was heard. Mr. A. E. Whitaker appeared for the defendant. The case was brought by plaintiff on the understanding that Signor Eiccardi, the defendant, was about to leave the colony without ptfyiug his creditors. The defendant stated he confessed judgment yesterday, and to-day received a summons to appear in this court. He filed his petition in bankruptcy in consequence of being pressed by several creditors. He had no intention of leaving the colony for ten weeks. It was impossible for him to leave aa he had entered into an engagement for that term to perform in the principal towns in the colony. He intended to carry the proceedings through the Bankruptcy Court in a bond fide manner by his solicitor. If the trustee required his personal attendance for examination he should be present. He could not hand over his operatic wardrobe, as he would be deprived of the means of making a livelihood. Mr. Whitaker asked if the Court would grant i time to his client for making arrangements. ' His Worship said if defendant w.oa leaving j in pursuit of his professional engagements it . was a very different matter to leaving with ] the intention of defrauding his creditors. ' He must adjourn the further hearing of the ; ease until the 26th instant. Signor Kiocardi f has been bound over to keep the peace to W. i H. Fenton in sureties of .£2OO for six months, i and was ordered to pay costs. 1
