The plaintiff, a contractor, handed to the defendant, a commission agent, a horse and dray to be sold. The property was disposed of, but the defendant failed to account for the money. — To ba paid within 14 days, in default six Weeks' imprisonment. In the following cases judgment was" given for the plaintiffs with costs i— Buller, Lewis and Gully v. Eoe, £\& 2s 7d; Steele v. M'lntosh, £Z 10s 6d ; Rive v. Spiers, £6 6s Bd. Symons v. Murphy.— .£l9 2s. Mr* Hutchison for plaintiff; Mr. Gordon Allan for defendant. The plaintiff, who lives in the cottntry, failed io attend, and the dase was adjourned till the 17th instant. The defendant naid he had come from Blenheim specially to defend the action, and had brought a witness with him. Mr. Hutchison promised to pay the expenses of the adjournment. Sidey'o Estate v. Strachan, £1. Mr. Fitzherbert for plaintiff. Mr. Sidey stated that the defendant agreed to pay him £1 towards defraying the cost of certain work performed for their mutual benefit. Mr. Straohan did not dispute this, but produced a receipt signed by Mr. Ladd, the trustee to the estate, for the payment of the money. Mr.,Fiteherbert elected to accept a nonsuit.
