WALLACE V. MARTIN. . _, Thiß action, which, as previously stated was one to recover ,£578 3s 9d for services, i &c, rendered by the plaintiff as auctioneer on behalf of the defendant, was continued after we went to press yesterday afternoon. The plaintiff was cross-examined at great length. He adhered to his statement that up to the time of the sale, it was distinctly understood it was to be an unreserved 'oaoc He regarded the property &s having bflfeif virtually withdrawn ;_a.*ale which was expected to realise more than iJ 100,000, bat the proceeds of which only amounted, to .£ISOO, could not be regarded as a sale at all. He added that Mr. Martin anticipated a profit of about .£50,000 on the transaction. Messr?. Duncan, Harris, fil'Lood, Dempsey, Kennedy, Pilcher, Dawson, Brace Wallace, and Wills were next examined. The substance, of their testimony was to the effect that they umderstood the sale was to be wholly without reserve.
