When the cisc against Mr. J. G. Kinross who was charged with having committed perjury before a Select Committee of the Legisla<ive Council some yean ago, was called on at the Resident Magistrate's Court this morning Mr. Rfle< intimated that he wi«hed to withdraw the ca-e for the present, but that he would briug it under tbe notice of the Legislature mxt s-e>si»n with the viaw of having a lull enquiry into the circumstances. He asked Mr. Man«.t..rd to instruct the Curk of the Court to retain all the documents connected with the case, and produce them to either side when required to do so. Mr. Mansford aereed t<» this, and the case was then withdrawn When the case was last before the Court the question was raided hy Mr. Kinross' counsel as to wlieth r or not Mr. Kinross was sworn wheu giving his evidence before the t-eleet Committee of the Legislative Council, aud Mr. Rees, who prosecuted, wi«hed to prove that Mr. Kinross was «o sworn by uutting in the appendices to the Journals of tha House. Mr. Mansford declined, however, to accept the appendices as evidence, t,n<t Mr. Rees then called Mr. L Stowe, clerk of the Legislative Council, but that gentleman declined to give a y evidence until he had been authorised by the < ouncil to do so. Under the circumstances Mr. Rees thought it better to withdraw the case.
