RESIDENT MAGISTRATE'S COURT. This Day.
(Before J. C. Crawford, Esq., It.M.) BREACH OF THE CITY COUNCIL BYE-LAWS. Sydney Parkes was charged, on the information of the. City Sanitary Inspector, with having thrown night soil into a stream running through Frederick-street, Te Aro. The summons was withdrawn, as the in spector had evidently got hold of the wrong man. . . ; W. S. Moss was charged, on the information of the Sub Inspector of Nuisances, with driving his cart across the footpath in Willis-street. It appears that there is a right-of-way by Mr. Douecker's, and that it has been the custom for carts to be driven up it, and of course they had to cross the path. This the City Surveyor urged wa3 contrary to the bye-laws, there being no bridging put over the gutter alongside the pathway. The Bench dismissed the case with a caution, as the offence had evidently been committed in ignorance. BREACH OF THE CONSTABULARY FORCE ORDINANCE. W. Chaplin was charged on the information of Constable Ward, with having left his horse and sarb unattended in the street, on Friday last, and fined 10s, ond costs 9s. DKUNK AND INCAPABLE. Robert Wall, for this offence, was fined ss, or in default committed for 24 hours. ■""'CIVJL CASES. S. Levy v. A. Burr—Claim £6 18s 4d. Judgment for amount, with costs 14s. Johnston v. Hadh'eld—Claim £9 0s 9d., This was a rehearing on the application of, the plaintiff, of a case which was before the Court on Friday last. The Bench reserved the decision then given on the grounds that the set-off put in was of the nature of unliquidated damages ; but judgment was stayed for three weeks, to give defendant time to commence a cross-action should he choose to do so.
