I, Thomas Dick, Superintendent of the rovinea of 0;;.,'.), do hereby, in pursuRce of the power and authority in me vested in this behalf, proclaim and declare the clauses, provisos, and conditions fol- ; lowing, as applicable to any Agricultural : Leases to be herafter granted under the provisions of the " Goldfields Act, 1862." and the " GoldfieldsAmendment Act, 1865, " relating thereto, that is to say : Ist. Agricultural Leases will be granted for a term not exceeding seven years. • 2:: d. Agricultural Leases will not be | transferable -without the special sanction land authority of His Honor the Suporin tendon*; and for every flitch transfer, a fee or fine of one pound (£1) will be charged. 3. The Government reserves to itself the right to survey through any hind held : under an Agricultural Lease, such roadsM as may be deemed essential for public con- • venienee, and to throw them open top public traffic, subject to the allowance of i valuation for improvements, and for any!' standing or growing crops which may be ■ in or upon such line of road at the period i when possession thereof is taken by the : Government. 4lh. The rer.t charged shall • be at the : rate of two shillings and sixpence(2s. 6d.) per acre, payable half-yearly in advance ' from the dale of application, and any i fractional part of an acre will be con-! sidered as an acre, and charged for ac-i: cordingly. •. sth. The Government reserves to itself ' the right of free ingress or ogress from anyp land so lease as aforesaid, end of entering! thereupon for the purpose of searching for:! gold, or any other metal or mineral, and ' of determining any lease when such! 1 i?.eta!s or minerals shall Lave been did- 1 covered thercou, and also of permittingj' prospecting, without compensation, upon ! i any unimproved land. !i Ctli. In the even; of the determination;' of any Agricultural Leasts, on accountj ! of the highly auriferous nature of the land, thereby demised, the amount of compensa-1 ■ tion adjudged to be paid to the holder; 1 thereof (except in special cases), lie con-] 1 tribaicd by the persons desirous of milling; t-Iscreon; but no compensation will boj' granted or adjudged for land which has; not been cultivated or otherwise im-|: proved. 7th. The fees charged for survey shall be as follows: * . For an ordinary survey, when the area; does not exceed twenty (20) acres, one pound. For any larger area, at the rate of one I shilling per acre, or any portion of an cere, Bth. Leases will be cancelled if the! land is sublet or transferred without the' sanction and authority of His Honor the! Superintendent, or if cultivation or other J permanent improvement is not commenced i within six months after the issue of the j i lease, or if at any time during the cur-! rency of the lease the land shall be; ! neglected for a period of six month. 9th. A fee of two pounds shall be! charged for every agricultural Lease, and if any applicant fails or neglacts to execute any such lease within one month after receiving notice from the Warden that such lease is ready for execution, the Government will proceed to cancel such lease, and the said fee of £2 will bn deducted from the original deposit. Persons applying for agricultural leases must strictly observe the following Regulations : Ist. Leases will be granted for a period not exceeding seven years, in accordance with the provisions of the "Goldfields Act, 1862," and of the Goldfields Acts Amendment Act. 1865." 2nd. Every application for an Agricultural Lease must be made (in the form of the schedule hereunto annexed) or to the Warden of the district, wherein the land is situate ; and copies of such application must be posted and maintained for a period of fourteen days, on boards not less than three feet from the surface of the ground, and erected, one at each corner of the land so applied for. 3rd. Every application must be accompanied by a deposit of ten pounds (.£10) to cover the costs of survey.- The balance, if any, of tuch deposit will be returned after the application has been finally dealt with.' - 4th. All land for which application shall have been made in the manner aforesaid, shall bo protected from the date of such application until the decision of his Honor the Superintendent ■ shall be made known to the Warden. Bth, Agricultural Leases will not be granted for lands within the boundaries of proc'aimed townships or public reserves, nor for any area including a permanent water-course, or which may present auriferous indications upon survey; and in all cases a public roadway, one chain in width, will be reserved along the margins of streams and rivers.
