The motion for loave to appeal in tho oaso Eogina v. Minnie Dean was argued before tho Appeal Court to-day. All the five Judges were present. Mr. Findtay appears to support tho motion, and Mr McDonald, Crown Prosecutor of Invercargill, and Mr Gully, Crown Prosecutor of Wellington, for tho Crown. Mr Findlay, in opening his case, statbd that he was unable to support the fleet ground of the notioo of motion. He could not contend that tho evidence as to tho inf .int Hornaby had be:m improperly admitted. Ho would contend, however, that the evidence aa to tho other iuitmtn, and tho finding of the Bkoletoa at the Lurches, hid been improperly admitted. Later. In the Dean oaso the Court deoidetkfco hear the Crown in reply at 10.30 on Monday morning.
