Mr. Findtay appears to support tho motion, and Mr McDonald, Crown Prosecutor of Invercargill, and Mr Gully, Crown Prosecutor of Wellington, for tho Crown. Mr Findlay, in opening his case, statbd that he was unable to support the fleet ground of the notioo of motion. He could not contend that tho evidence as to tho inf .int Hornaby had be:m improperly admitted.
