Miscellaneous By-laws.

356. No person shall bring or cause to be brought into tho Borough, or carry or cause to be carried through the streets thereof whether public or private, in any cart or other vehicle, any butchers' meat or carcase of meat, unless such cart or other vehicle be so constructed so that the rays of tho sun and the nun and dust are not allowed to fall on, or be capable of reaching, such meat or canmse of meat, and that proper sitting accommodation be provided for the driver thereof. ' ■ ■ 357- No person shall sell, or expose for sale, within the Borough any diseased, unsound, or unwholesome, meat, bread, flour, groceries, or any other kind of food or provisions, and no person shall eeilj or offer for sale, within the borough any butcher's meat which shall have hud air blown under 'Mo skin thereof, or phall uave had any fat or grease spouted thereupon.

358. Except as hereafter mentioned, no procession shall hereafter be allowed in any public or private street or public place within the Borough, unless the persons intending to form or take part in such proceHeion shall have previously received permission (by resolution of the Council) to form or take part in such procession.

359. JNo person shall be allowed without such permission as aforesaid, to play any musical instrument, beat any drum, or siug any song, or carry for the purpose of display any flag <>r torch, in any public or private street or public place in the Borough.

The two foregoing By-laws shall not affect any drill, mareli, or parade, of Volunteer or other troops under the command of any officer serving in Her Majesty's Volunteer or other forces, or any procession of school children under the direction of their teaohers, or any funeral procession, or any parade or drill of the members of the Napier and Spit Fire Brigades, or Fire Police. 360. The following by-lawt. numbers 361 to 405, both inclusive, shall be read and construed as if the words " within the Borough" were inserted m each of the said by-laws.

361. No person shall throw or sweep any glass, filth, dirt, rubbish, orange-peel, or other matter of a similar nature, or any earth, etoues, or other material, upon or into any public or private street, right-of-way, or public place. 362. No person shall lead or ride any horse or other animal, or draw, wheel, or drive any cart, carriage, sledge, truck, barrow, or other thing upon or along aDy footpath, without permission from the Council, or carry any load on his shoulders or otherwise to the danger or obstruction of persons using such footpath. 3G3 No person shall burn any shavings, straw, or other materiais or matter, upon any public or private street, right-of-way, or public placa, without permission of the Council.

364. No person shall draw, or trail any sledge, timber, or other material, upon any public or private street, right-of-way, or public place, to the injury of such public or private street, right-of-way, or public place. 300. No person shall allow night soil, or other offensive matter, to be spilt, or otherwise cast, on to or upon any public or private street, right-of-way, or public place. 366. No person shall place any placard or other document, writing, or painting, on, or otherwise deface, any land, house, or building, or any wall, fence, lump-post, or gate, without the consent of the occupier or owner thereof or steucil, or pluce any placard on, any public or private street, or public place, without the permission of the Council.

367. No person shall allow the droppings from the eaves of any house or verandah to fall upon any footway or roadway of any street.

308. No person shall open any drain or sewer, or remove tho surface of any footway or roadway of any street, or make any cellar door or other opening in the footway or roadway of any street, without the permission of the Council.

369. No person shall cause a nuisance by offensive smell or otherwise through neglecting to clean any private yard, wuy, passage, or avouue.

370. No person shall roll any cask, beat any carpet, break in any horse, fly any kite, ute any bows and arrows, play at any game, in any atreet or public place to thti annoyance of any person, or obstruct any street, or public place, whether by allowing any cart or animal to remain across such street or public place, or by placixijj gnoda thereon or otherwise. 371. No person Bhall throw or discharge

any stone or other missile, to the damage or danger of anj person or property. 372. No person shall leavo any dead beast on any public or private street, right-of-way public place, or on any private property, whereby nn offensive smell is created.

373. tfo person shall slaughter any cattle.

374. No person shall have any awning on or over any footway in any public street or thoroughfare, no 1 : being nine feet clear above thu footway, nor obstruct the footway by the supports uf such awning or verandah, nor hang any goods on or under such awning over the footway. 375. No person shall blast any rcok, stone, quarry material, or timber, in or near any public or private street, right-of-way, or public place, without permission of the Council.

376. No person shall furiously or negligently ride or d:ive through any public or private street, right-of-way, or public place.

377. No parson shall expose in any public or private street, or public place or thoroughfare, except in any fair or market lawfully appointed for that purpose, any horse or other animal for show, hite, or aale.

378. No person shall in or within sight of any public or private street, right-of-way, or public place, permit any male animal to serve a female animal, or (permit a female animal to be brought to a male animal, or a male animal to be brought to a female animal, in order to ascertain if suoh female animal is in season 379. No person shall sell, or expose for sale, or have in possession with intent to sell, any unwholesome meat, fish, ham, poultry, fruil:, Vegetables, or milk. 380. No person shall expose for sale any article whatsoever on any footway; or outside any shop, window, or doorway, abbuttii)g on any publio or private street, right-of-way, or public place. 381. No person shall discharge any firearms, or carry any fireams, sword, dirk, dagger, or other offensive weapon without permission of tho Council: Provided that the provision last aforesaid shall not apply to any Justice of the.Peace, or any person in Her Majesty's military or naval service, or any member of the police or other peace officer, or any member of a recognised Volunteer corps, or any special constable, or any person actually in pursuit of any felon or offender. 382. No peraon shall place any obstruction upon any public or private street, right-of-way, or public place, whereby life or limb in. likely to be endangered. 383 The owner and occupier shall keep in good repair every rail, gate, fence, or cover, over or about any area or entrance to any celar or other place, and shall not keep open for more than a reasonable time for taking in or out any articles, any entrance to any aroa, cellar, or other place (such area or entranae,opening into or upon or near any public or private street, right-of-way, or public place). 384. No person shall throw any offensive matter, or any animal, with the intention of drowning it, into any watercourse, or other place within or without tho Borough, from whence a supply of water for the use of the inhabitants of the Boroughisobtained, or throw or leave any dead animal or any portion of a dead animal or offensive matter of any kind, on to or upDn any public or j private street, right-of-way, or public

place. 385. No person shall suffer any dead animal, or aiiv part thereof, to rtmain' anburied upon bin land or on premises in his occupation adjacent to any public or private strest. right-of-way, or public place, so as to become a nuisance. 386. Any tree or shrub, or portion of any tree or shrub, overhanging any part of any public or private street, right-of-way, or public p'aco, shall bo removed on notice given so to do by the Overseer of Roads, or other authorii-.ed" officer of the Council, and any person to remove such overhanging freo or shrub, or portion of such tree or shrub, after such notice shall have bten served shall be deemed guilty of an

offence. 387. No carter shall Tide on any cart, dray, or waggon, without having and holding proper and sufficieut reins, unless some competent person shall hiivo charge of tbe animal or animals drawing the snme, and no carter shall be away from such animal or animaln so ai to bo unable to have the full control thereof. 388. Every psrson driving any vehicle whatsoever, or riding any animal, shtll when meeting nuy other vehicle or animal keep on the left or nuar side of tbe street; and when passing any other vehicle or animal goinu in the same direction shall go or pass or allow any person de.-irous so to do to paas, when practicable, on the right or off nide of such other vehicle or animal. 389. No person shall drive or ride any private carriage, bugiry, or other vehicle, or bicycle, or tricycle, through any publio or private street, or right-of-way, or public place, after sunset and before suuriae, unless such oarriaure, buggy, or vehicle, shall be provided with proper sidelights, and unless such bicycle, or tricycle, shall be provided with a proper front light. The rider of auy bicycle or tricycle, shall carry an alarm bell and shall ring such bell after dark when meeting or approaching auy vehicle or person on horseback, and when approaching auy person crossing any street whether on foot or horseback. 390. No driver of any vehicle, and no person riding on horseback, or riding any bicycle or tricycle, shall drive or ride at any other than a walking pace round or across any corner, angle, or intersection of any of the public or private streets, rights of way, or public places.

391. No person shall drive any cart, dray, waggon, or other vehicle, or allow the came to siand upon or allow any horse to walk over or stand upon, any asphalt or concrete footway.

302. No person shall load or unload any vehicle unless the came during such loading or unloading be drawn up parallel to the water channel or the kerbiug therwf.

393. No person shall drive any dog or goat harnessed or attached to any vehiole through any public or private street, right-of-way, or public place.

394. Wo person ehall act as a driver, or have the sole charge of more than one vehicle on any public or private street, right-of-way or public place, unless in cases where two of such carts and no more shall be drawn each by one horse only, and the horse of the hinder of such vehicle shall be attached by a sufficient rein to the back of the foremost of such vehicles.

395. No person shall leave upon any public or private street, right-of-way, or public place, any plough, harrow, cart, or other vehicle, without any horse or animal harnessed thereto, unless in consequence of some accident having occurred.

396. No person shall leave standing or lying upon any part of any public or private street, right-of-way, or public place, any truck, wheelbarrow, or other similar thing, or any packing case, crate, backet, barrel, package, or any other incumbranoe.

397. No person shall clean or repair any cart, carriage, waggon, orotber vehicle, in any public or private street, right of-way, or public place, except in cases of accident when repair on the spot is necessary.

395. No person shall drive through or upon any public or'private street, right-of way, or public place, any vehicle laden with such goods or material which project on either side more than 2 feet from such side.

399. No person shall destroy, damage, pollute, or obstruct, an aqueduct, dam sluice, pipe, pump, watercourse, or fountain.

400. No person shall suffer or allow any waste or impure water or other matter to remain in any collar, or place within any building or premises, or allow any waste or impure water or other zuattuc to run or to flow from any such building or premises, upon or over, or be on, any public or private street, right-of-way, or, public plaoe, or shall allow the contents of any water-closet, privy, or cesspool, to overflow, or to conk therefrom so as to be offensive.

401. Every person being the owner or tenant of any buildiug, abbutting on any public or private street where the footpatu has bson formed, shall secure and maintain the foundation of such building, and shall not cause or allow the formed footpath to fall in, or be otherwise damaged.

402. No person shall keep any disreputable house, or house of ill-fame, or havt the the control, conduct, or management of the samp, or be a reputed occupier, or an inmate of any suoh house.

403. No person shall without the authority of the Council cut. break, bark, root up, or otherwise destroy, or damage, the whole or any part of, any treo, sapling, shrub, or underwood, growing in or upon any public or private street or public place way land or premises undvr the management of the Couuoil although the injury done shall not be of tho amount of one shilling. 404. No person ehall without the
