Wellington, This day. A question reserved by ,Mr Justice Connolly at tho recent sitting of the Supreme Court, at Auckland was considered by the Appeal Court, ;his morning be'ove a full Bench. It seens a man named Edmund George was coinuii'ted by the jury of improper intimacy with v girl between tho ages of 14 and 10 years, und-r Statute of ISSO It ; s made a' god defence to such charge that the aceu-ed shall be able to make it appear to the Court or iury that he had reasonable ground t to beiieve the girl over sixteen In thin ease the jury convicted the accused, but, the Judge was of opinion that the iice.u«ed had good groundfur believing the girl to b- over sixteen. Mr Gully appeared for the Crown to support the case of the proseouti-.m. Tho question at issue wan whether or not the Judge's opinion should override (tie jury's conviction. The Chief Justice had some doubt on the point, but tho other Judges wero unanimous in holding that upon Mr Justice Conolly's opinion the accused was entitled to acquittal. The conviction was accordingly quashed.
