New Plymouth, This day. The jurymen having recovered, the murder case was resumed this morning. Mr Sainurl opened the defence, and dissected tho evidence brought by the prosecution. J He said accused's possession of the boots' was entirely separate from the murdor. Tho evidence of the clothes was merely an assertion by a witness that Maloney had things like them. Ho would call evidence to amply meet the charges made against the accused. The Maori witness who slept tho previous Sunday and Monday nights in tho sumo bedroom with accused noticed accused had on creaking boots liko those produced, also drawers and a blue ,»erge waistcoat. The owner of the boarding house was also prepared to corroborate that evidence. Two witnesses wero prepared to swear they saw Maloney in tho town as lute as ono o'clock on the day of tho murder, but according to the prosecution, tho accused was seen in town at half-past twelve. Mr. Samuel further said ho would show that accused could uot have been at the place whoro tho murdor was committed at the time tho prosecution states tho deed was done. Harriet Ward deposed to seeing Mulouoy iv Carrie street going homeward at one o'clock on tho day he was said to havo been murdered. Sho could not mistake him for

another as sho had known him from child-h-od. In cross-examination Miss Ward still adhered to seeing Maloney at one o'clock on the day of the murder, and did not mistake auy body else for him. Michael M".her, foreman of works for tho Borough Council, was positive ho saw Maloney going iv tho direction of tho Recreation Ground on the day ho was murdured about a quarter past one.
