Any member desiring relief from the Accident Fund shall make application in writing to the secretary stating the grounds of his application, and the secretary shall forthwith refer the same to the Council, which shall investigate the matter, and make such allowance to the applicant as it shall think proper. 28. The rules shall be kept duly posted iv the offices of the association, and every member shall be entitled to a copy thereof. 29. A list distinguishing the office-bearers and members, with their respective addresses, shall be always kept in the offices of the association. 30. The members of this association are not partners and are not in any way responsible for the acts of each other. 31. Any member of the association guilty of any offence that will bring discredit, or disgrace on the association, shall be expelled or dealt with as the Council may deem fit. 32. As soon as possib'e there shall be formed and constituted a Board of Conciliation, in the manner, for the purposes and with the powers and duties set forth in the following rules. BOAKD OP CONCILIATION. 1. The name of tho Board shall be " The Board of Conciliation for Hawke's Bay." 2. The objects of the said Board shall be to investigate such disputes between employers and workers as are duly and properly referred to it under the provisions of these rules, and to recommend such terms of adjustment as may seem to and be declared by it to be fair and reasonable. 3. No strike or lock-out shall under any circumstances whatever be threatened or resorted to until the matter or matters in dispute shall have beeu referred to the Board of Conciliation, and the decision of such Board shall have been refused recognition and observance. 4. The said Board shall consist of a ohairman to be elected as aftermentioned, and not more than twenty and not less than fourteen members, who shall be chosen by tho members of the association, in the proportion of one half by and from the employers and one half by and from the workers ; and if any question shall arise as to whether any person belongs to the body of employers or to the body of workers, the same shall be referred to the Council of the association, whose decision shall be final. Nominations shall be lodged with the secretary of the association at least three days before the meeting to be held for the purpose of electing such Board 5. The said Board shall be presided over by a chairman, who shall be elected by a majority of at least three-fourths of the whole Board and who withsuch Board shall hold office until the next ensuing annual general meeting. Such chairman shall not necessarily be a member of tho association, but shall be a person in the opinion of the Board of known probity and imnartiality. The chairman shall have one rote only. In the event of the Board being unable to agce-i upon the appointment of a chairman it shall proceed to the nomination of not more than six suitable persons whose names shall be submitted to the Council of the Association and the Counoil shall then proceed to appoint a chairman from the persons so nominated. Should the Board be unable to agree upon any names to be so submitted to the I Council, the Council shall itself appoint a j chairman. | 6. The said Board shall take action only at the joint request made to the secretary in writing of twenty or moro members of the association entitled to the assistance of such Board between whom some disputed question within the jurisdiction of such Board shall have arisen, or between this association and other kindred associations, between which some such disputed question shall have arisen. 7. So soon as the members of the said Board shall have been duly appointed, it shall be their duty to consider themselves as representing no particular side in any dispute upon the adjudication of which they may be engaged ; but to regard themselves as arbitrators appointed to consider every interest concerned, and to act in the joint interest of all; and it shall further be the duty of every such member to divest himself as much as possible of any disposition of feelings which may lead him to regard one side more favorably than another. 8. Every member of tho said Board, appointed by either of the two hereinbeforementionod bodies, shall, unless removed as hereinafter, provided, be and remain a member of tho said Board during the whole period for which he shall have been appointed by either of tha said bodies ; but in iio case shall any such member be appointed at any ono time for a longer period than twolve (12) months, and he shall be subject to removal at any time, by resolution of the particular body by which he was I originally appointed. 9. The members of any Board of Conciliation for tho time being shall hold office until the appointment of their successors. 10. In every case in which a vacancy shall occur among the members of the said Board such vacancy shall be filled by the remaining members of the body on such Board in which such vacancy shall have occurred appointing a person from the particular body from which tho member whose seat shall have become so vacant was elected. 11. A vacancy shall occur in tho said Board by the happening of any of tho following ovents :—Death, resignation, bankruptcy, absence (without such re.-isous as are in tbe opinion of the Board satisfactory) from three consecutive sittings of the Board. 12. A quorum of the said Board shall consist of not less than eight members and the chairman present at any sitting of the Board, but such quorum must at all times consist of an equal number from each of the bodies from whom such members shall have been elected, and in case it shall be found at any meeting that there are unequal numbers from such bodies, then unless by arrangement a number of members from the body in excess shall retire from the meeting, a ballot shall be taken as to which members of such body so in excess shall retire from such meeting, and the members so ballotted out shall forthwith retire. 13. Any member or members of the Boaid directly interested in any question upon which the Board is about to adjudicate shall upon the passing of a resolution to that efi'et bo disqualified from taking any part in such adjudication, and thereupon the members representing each body shall be equalised in accordance with Rule No. 12. 14 All questions brought before the Board shall be decided on the voices of those present, or if necessary by a show of hands in the usual man_er, or by ballot when d6manded. lii. The said Board shall conduct its deliberations at such place as its members, when called together, may from timo to time deem most advantageous to all parties concerned. 10. Should tbe Board of Conciliation for tho time being be unable to agree upon any question referred to it, the chairman sball at ouco report such want of agreement to the Council, and the Council shall thereupon, in order to avoid a strike, lock-out, or other complication, forthwith call a general meeting of members, which meoting- shall proceed anew to tho election of a Board of Conciliation to take the place of the existing Board, and tho existing Board shall thereupon cease to hold office. 17. All members of tho association shall bo bound and pledge themselves to accept as final all decisions of such Board on questions within its jurisdiction. 18. The, said Board may from tune to timo, as it thinks fit, appoint, suspend, or remove a secretary for the convenience of the Board, and such secretary shall, if necessary, be remunerated by this association. 19. With the consent of the Council the said Board may mediate in any dispute arising between employers and workers, although not members of the association. 20. In case one of two or more parties to a dispute shall refuse or delay to refer the same to the said Board, then Much Board may proceed to the consideration of the matter in dispute and come to a decision on the siime in tho absence of the party so refusing or delaying to refer the same. 21. Tbo rules of the said Board may from time to time be altered by the t--aid Board by resolution of the Board onriicit for that purpose approved and confirmed by the association, but the said Board sball itself make rules providing for the manner in which its proceedings shall bo conduct.*^, i and for the payment by, and apportionment among, tho parties to such proceedings of the costs and expenses thereof. The Board may recommend the Counoil to contribute towards tho expenses in such cases as it thinks proper. 22.
